The Nelson Law Firm is currently representing homeowners throughout the country whose homes were constructed with floor joists that use a Weyerhaeuser product known as Flak Jacket®, which contains formaldehyde.
Weyerhaeuser issued a press release on July 18, 2017 acknowledging that this issue affects all Weyerhaeuser joists manufactured with the Flak Jacket® product after December 1, 2016, which has or will impact at least 2,200 newly constructed homes.
Homeowners who have moved into their homes with the Flak Jacket® coating on their floor joists have been advised to move out of their homes and to seek medical attention for any symptoms arising from exposure to the product.
Symptoms can include watery or burning eyes, nose and throat irritation, wheezing, coughing, breathing difficulties, fatigue, skin rash, allergic reactions and neurological issues if exposure occurs at elevated levels.
The EPA has classified formaldehyde as a probable carcinogen, and the National Cancer Institute has reported that formaldehyde exposure is associated with certain types of cancer in humans.
Homeowners have been advised to immediately move out of their homes by numerous national home builders, but have largely been kept in the dark about what repair, if any, can be made to solve this problem and how they are going to be reimbursed for food and lodging, mortgage payments, medical expenses, loss of home value, and loss of use of their homes, all of which are compensable under Colorado law.
